The employer must make partial wage payments to a worker injured on the job if that injury temporarily prevents the worker from doing his job or any light duty job the employer may offer. This payment is called Temporary Total Disability (TTD), and it is paid as long as the employee is unable to perform his job or a substitute light duty job. The amount of the payment is two-thirds of the worker’s average gross weekly wage, calculated over the 52 weeks before the injury (subject to minimum and maximum rates).

Another type of temporary disability is called Temporary Partial Disability (TPD). This is paid when the employer has a light duty job that the worker can perform, but the job pays less than the regular job the worker was performing when he got hurt. Under these circumstances, the employer must pay a weekly sum equal to two-thirds of the difference between the net amount the worker receives in the light duty job and the gross amount he or she would ordinarily receive in the full performance of his regular job.

In order to avoid delay or interruption in medical or wage benefits, you must always keep your doctor or therapy appointments and get a work status note from the doctor at the end of each appointment. Also make sure you tell the doctor about any ongoing problems with the injury so he or she can make appropriate treatment and return to work recommendations. Don’t exaggerate your symptoms but don’t conceal or minimize them either. Important decisions are made based on what you say.

For a more detailed description of temporary disability benefits, see the Illinois Handbook on Workers’ Compensation and Occupational Diseases.

The financial survival of families impacted by work injuries depends on the prompt and timely payment of temporary disability benefits. If you are injured on the job, you were injured in the service of your employer and the law requires that you be paid while recovering from those injuries. Don’t let delay or denial by an insurance company traumatize your family any more than the injury already has. Contact a lawyer experienced in workers’ compensation cases to fight for you and your family.
